By using our services, you agree to comply with our policies. We expect you to have a basic knowledge of how the Internet functions, the types of uses which are generally acceptable, and the types of uses which are to be avoided. Common sense is the best guide as to what is considered acceptable use. The following are unacceptable uses: Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, harassment, fraud, drug dealing, hardcore adult content, and other illegal activities.
Interpretation
The provisions of this Policy are intended as guidelines and are not meant to be exhaustive. Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this Policy, is prohibited. Smile Website Host reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill, which includes termination of services provided at any time.
Illegal Use
Smile Website Host services may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited.
System and Network Security
Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: unauthorized access, use, probe, or scan of a systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Smile Website Host has a "zero tolerance" policy regarding Denial of Service Attacks. Smile Website Host reserves the right to terminate any Hosting account or Dedicated or Managed Server or Co-Location account which has been the target of a Denial of Service or similar type attack.
No Smile Website Host account may be used for:
- Email spamming
- IRC Hosting or Services of any kind
- Warez, Hackz or Serialz sites.
- Illegal content or activities
- Any other type of high packet load or disruptive network traffic
- Ask before you attempt something questionable, it will save us all a lot of trouble.
Spamming
Directly or indirectly transmitting or supporting the transmission of unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is expressly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site.
Charges
All recurring charges shall be due and payable in advance on the day of the month you signed up on for every month of the year. Invoices or notices of invoices for recurring charges are issued as a courtesy.
Non-recurring charges including excess bandwidth usage and overages will be due and payable upon Customer’s receipt of invoice or notice of invoice. Customer is responsible for monitoring transfer or bandwidth consumption and other services provided while maintaining awareness of the applicable charges due. Bandwidth overages are charged at $5 per each GB used over the allowed limit of the package.
Consequences of Violation
When Smile Website Host becomes aware of an alleged violation of its Acceptable Use Policy, Smile Website Host will initiate an investigation. During the investigation Smile Website Host may restrict Customer's access in order to prevent further possible unauthorized activity. Depending on the severity of the violation, Smile Website Host may, at its sole discretion, restrict, suspend, or terminate Customer's account and/or pursue other civil remedies. If such violation is a criminal offense, Smile Website Host will notify the appropriate law enforcement department of such violation. Smile Website Host does not issue service credits for any outages incurred through service disablement resulting from Policy violations.
Modification
Smile Website Host reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
Reporting Network Abuse
Any party seeking to report any violations of Sile Website Host's policy may contact via e-mail: abuse@SmileWebsiteHost.com
Backups
Smile Website Host is in no way responsible for data loss or money lost due to loss of data. While we strive to keep all data backed up on a daily basis for emergency use in the event of hardware failure or similar situation, there may be certain conditions or events that could cause problems with our backup process and we urge clients to keep their own backups.
Cancellation / Termination
All cancellation requests must be sent to terminate@SmileWebsiteHost.com . You may also email billing@SmileWebsiteHost.com for cancellation requests but we may require further verification when doing so. Cancellations must be made prior to the next billing cycle. Payments made up to the point of cancellation cannot be refunded.
Smile Website Host (http://www.SmileWebsiteHost.com) reserves the right to terminate any client or account at it's sole discretion without notice.
All techincal service requests will be answered within 3 business days not including holidays.
Date Service Level Agreement
Smile Website Host utilizes a 100% Cisco network consisting of dual Cisco 12008 routers handling the edge routing, dual Cisco 7513 routers handling core routing, and dual Cisco 5513s handling distribution. All Cisco equipment is powered by dual DC power supplies which we keep in stock. Each router is fed by totally diverse DC plants.
Currently Smile Website Host utilizes bandwidth from Level (3) (NASDAQ: LVLT) and Time Warner Telecom (NASDAQ: TWTC). Both connections are fed via diverse entrance and diverse routes.
